Arresting Villains?

I have noticed on several occasions in melee range of super or master villains i have a "arrest" button pop up. When i press it i usually get a dialog screen that says something to the effect "Take me back to prison, just please dont kill me!" but the villain continues to fight to the death no matter what i do. Has anyone else seen this? If so, do you have any suggestions on how to make it work or is it just broken?

That's on the 5 master villains for the bounty hunter perk in the desert.
Also, you can "talk to" a supervillain in the cat-lady mission in post-crisis MC.

Just fluff, I think.
